Caltrans changing DVBE goals |

The California Department of Transportation
(Caltrans) is upping the ante
on Disabled Veterans Business Enterprise
(DVBE) “goals” on state-only funded construction
contracts. The agency says they
haven’t been meeting the requirements put
on them by the legislature, so they’re going
to try harder.
The change was announced at a recent
meeting with Caltrans staff and representatives
from the Engineering and Utility Contractors
Association (EUCA) and the
Southern California Contractors Association
(SCCA). These joint association meetings
happen every quarter, usually in Sacramento,
to help our contractors deal with the
ever-changing Caltrans bureaucracy.
“This change is being made to help
the department meet and exceed the annual
3 percent DVBE participation requirement
for state-funded contracts,”
said Kris Kuhl, chief, Office of Contract
Awards and Services.
The new DVBE goals go into effect with
projects advertised March 21, 2011. If you

Section 2-1.02 and—just to make sure you
get it— each contract contains a Special
Notice alerting bidders to Section 2-1.02.
The whole business of DVBE goals
jumped up during one of the special
budget sessions when the legislature
passed AB 4X 21. Among the provisions of
that law was one that eliminated “good
faith effort” for DVBE provisions on statefunded
contracts — you either make it, or
you don’t and even as low bidder the project
can be awarded to the next bidder who
does.
“Bidders are also cautioned that DVBE
participation is only counted for certified
DVBE's performing ‘commercially useful’
functions on the contract,” said Kuhl.
SCCA’s new Community Outreach Committee
is working to help our members
who qualify to take advantage of these
“goals” and to recruit new members for
the association to help our general contractors
take advantage of the bid incentives.
